Canada considers harsher penalties for ‘honour killings’

From Cnews:

h/t Grace

OTTAWA — Public Safety Minister Peter Van Loan opened the door to tougher penalties for honour killings yesterday, saying it is a crime Canadian society cannot accept.

“This notion that it is appropriate to kill a family member because of your disapproval of their lifestyle or choices like that is simply unacceptable in our society. I have a very serious problem with that.”

Van Loan’s comments come less than a week after Mohammad Shafia, his wife and son were arrested and charged with first degree murder and conspiracy to commit murder in connection with the deaths of three daughters and a female member of his family. The women were found in a car underwater in the Rideau Canal in Kingston in what some suspect may have been an honour killing.

Speaking to reporters outside a Conservative caucus meeting, Van Loan said murder is already against the law and the Shafia case will be tried under the existing criminal code.

However, Van Loan said he would be willing, if necessary, to look at changes to the law.

“I’m certainly open to seeing whether there is a place for changes but up to this point, I haven’t seen that there is a need for changes to the criminal code. Certainly that is something for the minister of justice to consider.”

Van Loan said he believes the very term honour killing is “highly inappropriate” and those who move to Canada need to know that “those kinds of norms and values” are not appropriate.

“We certainly try to encourage people when they come to Canada to recognize the importance of Canadian values and to respect the laws of this country. That’s something that we expect all people who come to Canada to do.”

Canada: Hizb ut-Tahrir to meet this week in Ontario

From R.E.A.L….

On Friday, July 31, 2009, the Islamic supremacist organization Hizb ut-Tahrir will be holding another public conference, this time in the Ontario, Canada city of Mississauga.  Unlike the July 19, 2009 Hizb ut-Tahrir conference which was held at a private facility in Chicago suburb Oak Lawn’s Hilton Hotel, the Canadian Hizb ut-Tahrir meeting will be held at a Canadian government-managed public facility, the Mississauga Valley Community Center.

1. Hizb ut-Tahrir Seeks to Promote Supremacism in Canada

The Islamic supremacist Hizb ut-Tahrir (HT) Canadian event is publicized on the Hizb ut-Tahrir web site as being sponsored by “Hizb ut-Tahrir Canada” as part of HT’s “2009 Khilafah Campaign,” which included the July 19, 2009 HT event in the Chicago Oak Lawn, IL suburb.  HT has advertised this event to be held at the Canadian govt-managed facility in Mississauga for: “Friday, July 31st, 6.30PM to 8.30PM, Frank Bean Lounge — Mississauga Valley Community Center, 1275 Mississauga Valley Blvd, L5A 3R8.”   The HT Canada event has also been promoted by a Toronto, Canada website called “TorontoMuslims.com”.  (R.E.A.L. contacted this Toronto Muslim website to ask why they were promoting such a supremacist organization’s event, and received no reply.)

The Hizb ut-Tahrir web site promoting the July 31 event in Canada also promotes a pamphlet (page 62) that supports killing those individuals who leave Islam as guilty of “treason and a political attack on the Khilafah.”

According to the Canadian Criminal Code Section 318:

“318. (1) Every one who advocates or promotes genocide is guilty of an indictable offence and liable to imprisonment for a term not exceeding five years.”
“(2) In this section, ‘genocide’ means any of the following acts committed with intent to destroy in whole or in part any identifiable group, namely,”
“(a) killing members of the group; or”
“(b) deliberately inflicting on the group conditions of life calculated to bring about its physical destruction…”
“(4) In this section, ‘identifiable group’ means any section of the public distinguished by colour, race, religion, ethnic origin or sexual orientation.”

Researcher Madeleine Gruen believes that U.S. member of HT Mohammad Malkawi may speak at the Canadian conference, because Mohammad Malkawi has previously given speeches in Canada.  HT’s Mohammad Malkawi moderated the July 19 HT conference in Chicago suburb of Oak Lawn.

2. Efforts to Alert Canadian Government Agencies to HT Supremacist Meeting at Govt-Managed Facility

Responsible for Equality And Liberty (R.E.A.L.) has attempted to contact the Mississauga government to make them aware of the supremacist nature of the Hizb ut-Tahrir organization that it has rented use of the Mississauga Valley Community Centre Frank Bean Lounge facility to for their July 31 conference.  After speaking to a representative at the Community Centre (905-615-4670), we were re-directed to the Mississauga government agency involved in booking the Frank Bean Lounge facility, the Mississauga government recreation and parks department (905-615-4100, choose “facility booking”).

R.E.A.L.’s Jeffrey Imm spoke to a manager with the  Mississauga recreation and parks department on this, and she stated that they are “looking into this.”  The Mississauga recreation and parks manager also stated the person who made the booking of the Frank Bean Lounge facility for the Canadian Hizb ut-Tahrir meeting had held “previous meetings” there, and Mississauga “never had any problems or issues” with them.  On the Mississauga web site regarding renting such facilities, one of the primary concerns is the use of such facilities in terms of serving alcoholic beverages.

In addition, R.E.A.L.’s Jeffrey Imm contacted the diversity relations unit of Mississauga local law enforcement — highlighting that the group promoting the Canadian HT event – is also promoting a brochure that calls for the death penalty for Muslims who leave Islam as guilty of “treason and a political attack on the Khilafah” (page 62).

3. Contact Canadian and Mississauga Legislators

We urge those concerned about the growing threat of the Hizb ut-Tahrir supremacist movement and its efforts to justify violence against those who seek freedom of religion to contact Canadian and Mississauga legislators to voice their outrage about this supremacist group using a Mississauga facility.  Apparently, this is not the first time such proponents of Hizb ut-Tahrir’s supremacist ideology have used Canadian public facilities either.  Contact Canadian and Mississauga government officials to get an answer as to why Canadian public facilities are being used to spread such supremacist hate.

Why it matters that honor killing has Islamic sanction

From Jihad Watch: h/t jdamn

“While the practice is not confined to a specific cultural group and has no links to Islam, there is ‘no question,’ Mr. Oppal said, the numbers of honour killings are higher in certain communities.”

No links to Islam? Really?

Consider these:

A manual of Islamic law certified by Al-Azhar as a reliable guide to Sunni orthodoxy says that “retaliation is obligatory against anyone who kills a human being purely intentionally and without right.” However, “not subject to retaliation” is “a father or mother (or their fathers or mothers) for killing their offspring, or offspring’s offspring.” (‘Umdat al-Salik o1.1-2).

In other words, someone who kills his child incurs no legal penalty under Islamic law. In accord with this, in 2003 the Jordanian Parliament voted down on Islamic grounds a provision designed to stiffen penalties for honor killings. Al-Jazeera reported that “Islamists and conservatives said the laws violated religious traditions and would destroy families and values.”

And related to the practice is this:

“The Messenger of Allah (may peace be upon him) used not to kill the children, so thou shouldst not kill them unless you could know what Khadir had known about the child he killed, or you could distinguish between a child who would grow up to he a believer (and a child who would grow up to be a non-believer), so that you killed the (prospective) non-believer and left the (prospective) believer aside.” — Sahih Muslim Book 019, Number 4457

Khadir, or Khidr, figures in sura 18 of the Qur’an. He is traveling with Moses, and: “Then they proceeded: until, when they met a young man, he [Khadir] slew him. Moses said: “Hast thou slain an innocent person who had slain none? Truly a foul (unheard of) thing hast thou done!” Khadir replies: “As for the youth, his parents were people of Faith, and we feared that he would grieve them by obstinate rebellion and ingratitude (to Allah and man). So we desired that their Lord would give them in exchange (a son) better in purity (of conduct) and closer in affection….” (18:74, 18:80-81). Continue Reading →

Mark Steyn: Kingston not a good place for female Muslims.

From The National Review:

Watery Graves [Mark Steyn]

Three or so weeks back, a submerged car was found in the Rideau Canal in Kingston, Ont., containing the bodies of three teenage girls and their aunt — a story initially reported as Mysterious Death Of 4 Quebecers Baffles Kingston Police. When it emerged that the four female Quebecers were, in fact, Muslim, the tearful parents offered up a strange tale of an impromptu midnight driving lesson gone tragically wrong (Driving Lesson May Have Led To Drowning).

La Presse is now reporting that the girls’ father, mother, and brother have been arrested en route to Montreal Airport, and that the deceased “aunt” or (alternatively) “cousin” was, in fact, the girls’ father’s first wife. The words “crime d’honneur” are beginning to creep into newspaper accounts.

Meanwhile, the blogger Scaramouche suggests that, while they’re looking into honor killings in the Kingston area, the constabulary might take a gander at another curious aquatic accident this month:

Police say 14-year-old Kinza Kaianad died Monday evening at Kingston General Hospital as a result of injuries she sustained Saturday in a hotel pool in Gananoque, roughly 30 kilometres east of Kingston.

Her mother, 43-year-old Naila Yasmin, died in hospital on Sunday.

Yasmin, Kaianad and another daughter, age 11, were found unconscious in the indoor hotel pool just before 9 a.m. Saturday.

There would seem to be a statistically improbable number of multiple drownings of female members of Muslim families in Kingston this summer. If you’re a young female Muslim, and you have any say in the matter, you might want to vacation elsewhere.

[UPDATE: The third Muslim girl found in the swimming pool has died. That’s seven drowned young Muslim females showing up in the same morgue within a month. In other circumstances, they’d be planning the movie with Ashley Judd or some such as the crusading feminist Assistant DA. But as the M-word’s involved I expect poor Zainab Shafi and the rest will be quickly forgotten.]

‘Honour killings’ of females on rise in Canada: Expert

From Canada.Com:

By Shannon Proudfoot, Canwest News ServiceJuly 23, 2009 8:46 PM

As many as 5,000 women and girls lose their lives — most at the hands of family members — in “honour killings” around the world each year, according to the United Nations.

Up to a dozen have died for the same reason in Canada in the last decade, and it’s happening more often, says Amin Muhammad, a psychiatrist who studies honour killings at Memorial University in Newfoundland.

“There are a number of organizations which don’t accept the idea of honour killing; they say it’s a Western-propagated myth by the media, but it’s not true,” he says. “Honour killing is there, and we should acknowledge it, and Canada should take it seriously.”

Kingston, Ont., police are now investigating that as a motive in the deaths of three teenage sisters and an older female relative who were found in a car submerged in the Rideau Canal in Kingston on June 30. The girls’ mother, father and brother were arrested on Wednesday and charged with first-degree murder.

“In our Canadian society, we value the cultural values of everyone that makes up this great country, and some of us have different core beliefs, different family values, different sets of rules,” Kingston Police Chief Stephen Tanner said at a news conference on Thursday. “Certainly, these individuals — in particular, the three teenagers — were Canadian teenagers who have all the freedom and rights of expression of all Canadians.”

He added that he’d received an e-mail from an extended family member of the girls, suggesting honour killing was to blame for their deaths. Continue Reading →

Kingston Police Call It A “Muslim Honor Killing.”

From Phyllis Chesler and Pajamas Media:

Family Charged with Four Counts of First Degree Murder and Four Counts of Conspiracy to Commit Murder

At 2pm est today, on a CFRA radio press conference, it was announced that the police have finally described the deaths of four Afghan-Canadian girls and women, as a “Muslim honor killing.” If the police are right, this is the fifth known honor killing in Canada since 1999 and it brings the death toll to nine victims. I am no statistician but I have friends who are and they tell me that this is a very high number given that the Muslim and Sikh population in Canada is no more than one million.

Let’s hear it for the Canadian police! They have just charged the Shahi family with counts of first-degree murder and four counts of conspiracy to commit murder in this case. In other words, they understand that both classic and often unique honor murders are planned and performed by families, not only by individuals.

Kingston police chief, Stephen Tanner said “It was a needless and senseless loss of human life…They had their lives cut short by members of their own family.”

Only once, in 2008, did our own FBI describe an honor killing as an honor killing. They did so in the case of the Said Dallas case but within ten days, they retracted that description. One can only imagine why. (And one does not know what the Canadian police or prosecutor will ultimately say).

This is also the second Afghan-Canadian honor killing. The first one took place in 2006, and was a brother-on-sister murder. The brother, Hasibullah Sadiqi, shot his sister and her fiancée in a shopping mall in Ottawa. Sadiqi stood trial in 2009.

Here is the background to this latest developing story in Canada.

DisplayPhoto.ashxThey married in Kabul in 1979, the year the Russians invaded. Rona Amir Mohammed was Mohammed Safi’s first and only wife—that is, until it was clear she could have no children. At some point, he married a second wife, Tooba Mohammed Yahya, with whom he had four (or seven) children: three daughters and one son. The daughters were all born in Kabul, the son might have been born in Dubai. They all moved to Canada two years ago.

No one in St. Leonard, a suburb of Montreal, knew that Safi was living with two wives. Rona, his first wife, was an intimate member of the family, variously introduced as a “relative,” an “aunt,” a “cousin.” From a Muslim point of view, Safi behaved honorably because he did not divorce or banish his first wife even though she was infertile. How polygamy itself as well as secretive polygamy may psychologically affect a family is another matter entirely. And, while Safi may have appeared westernized, that was far from the truth.

Last month, 50 year-old Rona, 19-year-old-Zainab, 17-year-old Sahar, and 13-year-old Geeti were mysteriously all found dead in a car submerged in the Rideau Canal. The car entered the canal backwards. This suggests that Rona had co-parented these girls and perhaps that she supported their westernization.

Is this really an honor killing? I am not sure but let’s consider these facts:

Safi, a polygamist, considered his eldest daughter Zainab, to be a “rebel.” He accused her of having a boyfriend. He also told the police that Zainab had taken the car “on a joyride.” Safi mocked Zainab’s driving ability.

The fact that his first wife was found dead along with the second wife’s “rebellious” older daughter suggests that Rona might have argued for Zainab or might, herself, have longed for a more westernized life. I am not sure why the two younger girls also had to die. Perhaps they were seen as already too influenced by their older sister. Maybe they were in the wrong place at the wrong time.

Well, it could have been a mysterious accident. But yesterday, the police arrested Mohammed Safi, his second wife, Tooba, and their eldest son on their way to Montreal’s Trudeau’s International airport. Why would they be leaving at this point? Where were they going?

Atlas Shrugs has the photos of the marriage between Rona and Mohammed of thirty years ago. Rona’s sister, Diba Massomi, sent them to the police. It was she who first suggested that this was an honor killing.

Massomi emailed the Kingston police and said that “for some time, my sister and the Shafi couple’s oldest daughter Zainab, had been receiving death threats for social, cultural, and family reasons.”

An honour killing? Ontario police make arrests:

Kingston Police have arrested at least three people in connection with the mysterious deaths of four Montreal women found in a submerged car in Kingston Mills on June 30.

Police sources confirmed the dramatic development in the case yesterday, 22 days after a black Nissan Sentra was found in roughly three metres of water near one of the four locks.

Three teenage sisters were found dead in the car, Zainab Shafi, 19, Sahar, 17, and Geeti, 13, along with a 50-year-old woman, Rona Amir Mohammed.

La Presse newspaper in Montreal said three people who were heading to Pierre Elliott Trudeau International Airport were arrested yesterday morning.

Initially, police said the case was suspicious but that they had not found evidence of foul play.

It’s not clear what charges are being laid, but the Whig-Standard learned that Kingston Police have been investigating, for at least two weeks, the allegation that the deaths were an honour killing. Continue Reading →

Islamic justice in the UK. Acid attack barbarity beyond comprehension.

anyone looking for a new business? How about acid proof veils for Muslim women? Acid proof clothing in general. Could be the next big thing.Maybe that’s why Muslim women started wearing face coverings in the first place.

The second option is some sort of metal cages around Muslim men. We used to call those jails.
[kaltura-widget wid=”ypdn4imubk” width=”410″ height=”364″ addpermission=”3″ editpermission=”3″ /]It infuriates me that they put ‘honor’ in single quotes but not ‘marriage’. The fact is, marriage in Islam has sweet bugger all to do with marriage the way we think of it. Slavery is far far more accurate in as much as their is a term in English at all for the forcing of women to become property to men for life. Even if a man divorces a woman, she cannot remarry by her own choice for fear of dishonoring the man who dumped her and therefore be killed for it.

From The Times Online:

A young Muslim woman has been warned by police that her life is in danger after a male friend lost his tongue in an alleged assault using acid in an apparent “honour attack”.

The Danish Asian man is in a serious but stable condition in hospital after an incident in Leytonstone, East London, three weeks ago. Sulphuric acid is said to have been thrown in his face and he was stabbed twice in the back.

The 24-year-old, being treated in a specialist unit in Essex, is now blind, his tongue has been destroyed and he suffered 90 per cent burns.

The woman, who claims the relationship is an innocent friendship, and the man live in the Asian community of East London, where their relationship is said to have upset her family for bringing dishonour on them.

Scotland Yard have issued what is known as an “Osman warning” — telling the woman that there is a threat to her life.

A police source told The Times that she had not been moved into a safe house but police were in daily contact with her. Continue Reading →

Couldnt be an honour killing could it? No nothing to see here folks the canal is full of cars full of drowned Muslims all the time.

National Post:

The mystery surrounding the deaths of three Montreal sisters and a relative whose bodies were found in a car in the Rideau Canal deepened yesterday as three people were arrested in Montreal, Global National reported.

The three were reportedly on their way to Montreal’s Pierre Elliott Trudeau International Airport at the time of their arrest.

Police would only say publicly yesterday that the status of their investigation into the Kingston-area deaths last month had changed.

Neighbours who spoke to Canwest News Service said investigators from both the Montreal and Kingston police forces spent several hours at the victims’ suburban home on Tuesday night.

Kingston police have scheduled a news conference for this afternoon and were expected to make an announcement about the status of the investigation.

Christian Man Raped, Murdered for Refusing to Convert to Islam, Family Says

Now if the main-stream media would only start reporting on the hundreds or thousands of cases of forced convertion that happen in Islamic society all under the nose of police and government officials. I’m sure some of this will be addressed in Obamas next speech to his Muslim brothers and sisters.

Convert or Die. Infidel

Convert or Die. Infidel

FOX NEWS
A young Christian man was raped and brutally murdered in Pakistan for refusing to convert to Islam, and police are doing nothing about it, the victim’s brother and minister told FOXNews.com.Pakistani police reportedly found the body of Tariq “Litto” Mashi Ghauri — a 28-year-old university student in Sargodha, Pakistan — lying dead in a canal outside a rural village in Punjab Province on May 15. He had been raped and stabbed at least five times.

“They have sexually abuse him, torture him with a knife on his testicle and genitals,” Ghauri’s brother, 24-year-old Salman Nabil Ghauri, said. “They have tortured him very badly, and after that they have stabbed five times with a knife and killed him.”
The family believes Litto Ghauri was murdered by the brothers of his Muslim girlfriend, Shazi Cheema, after they found him in a compromising sexual position with their sister.

The Rev. Haroon Bhatti, a Christian clergyman in the village and a friend of the Ghauri family, said Cheema’s three brothers came to Litto Ghauri’s house on May 11 and gave him an ultimatum: Marry their sister and convert to Islam.“On that farmhouse — four days there — we all, Christians and family, were searching for him,” the Rev. Bhatti said. “I was with him. I was searching for him.”

After police discovered the body, Ghauri’s death was declared a homicide and the family filed paperwork with the Atta Shaheed police station in their small village, Adda 44SB. But Ghauri’s brother said police still have not arrested the alleged killers and have refused to meet with his family. Continue Reading →

Sadiqi gets life for femicide of sister

Canada adds another point in the growing list of reasons to be proud of being Canadian today as judge and jury find that being Muslim is not an excuse for murder. Today is a good day to be Canadian.

From the Ottawa Citizen:

Hasibullah Sadiqi has been found guilty on two counts of first degree murder. The jury deliberating a verdict delivered their decision Saturday morning. The decision carries an automatic sentence of life imprisonment without the possibility of parole for 25 years.

The Ottawa Citizen

A “twisted sense of values” led an Ottawa man to murder his sister and the man she loved, the judge in an honour killing trial said Saturday.

“You put your own self-esteem over those of your own sister and the young man she had chosen to become her life partner,” Ontario Superior Court Justice Douglas Rutherford told an expressionless Hasibullah Sadiqi. “And consigning them to partnership in death has shocked and bewildered every community in the nation’s capital. The forfeiture of your liberty for the rest of your life seems only just.”

Minutes earlier, the jury returned a verdict of guilty on two counts of first-degree murder against 23-year-old Sadiqi, who gunned down his 20-year-old sister, Khatera, and her fiancé, Feroz Mangal, 23, in the early hours of Sept. 19, 2006 while the couple was sitting in her parked car.

PBS on the Taliban, use of children as weapons, Islam and Pakistan

This video from PBS:

Despite this journalists wonderful detachment and staunch effort to show an even objective expose of this issue and these people, it is difficult not to notice the fear she hides when she is face to face with some young turdburger who tells her the government must treat women as plastic bags. You can see she is in immediate danger for her life if she argues the point. These people, Islam, does not debate. These are not Jews. Much of this documentary has nothing new for readers of Vlad. But there are still some shocking revelations about  how serious Islam really is in terms of illiberal values and it’s ambitions for the rest of us, and perhaps mpore interestingly, when PBS does an expose showing the horrors of Islam to this extent. you know things are bad. We expect the facts from FOX when they may not be PC. Its quite another thing when PBS calls it like it is.

A defence you can garden with. The Sidiqi trial continues:

Once it’s finished you can fertilize a whole public park with it. I wonder where I can get a job holding a gun for someone who pay’s me $500.00 a month. Hell Ill hold 4 of them and never bother working at all. I guess as he say’s in the last couple of paragraphs, he has a part time job making martyrs as well.

From the Ottawa Citizen:

After shooting his sister and her fiancé, there was silence, Hasibullah Sadiqi told a jury on Friday. He remembered his ears ringing, and a .44 Magnum revolver in his hand.

Sadiqi, his sister, Khatera, and her fiancé, Feroz Mangal, had been out for dinner and movie with friends that night in September 2006.

On their way back to the Elmvale Acres shopping plaza, where Sadiqi had left his car, it was “pretty tense” as they entered the parking lot, Sadiqi testified at his murder trial.

Conversation had turned to their father, from whom Khatera was estranged, Sadiqi said.

Sadiqi told the court he had wanted his sister to speak to their father or at least respect and understand that he was “there for us,” during their youth. Sadiqi had hoped Mangal, as “an Afghani guy too and as a man,” would take his side and back him up, but instead, he stuck up for Khatera, Sadiqi testified.

Sadiqi said he tried to persuade his sister that their family needed unity around the engagement time, but the couple was being “hard-headed.”

Frustrated, Sadiqi eventually left the car and gave a dismissive wave, he testified. Then, he said, Mangal spoke.

“He said, ‘f— you, f— your father, f— your sister. I’ll bring your sister’s dead body to the wedding before I ever let her talk to your father. F— you,” Sadiqi told the court.

“Right there, I just exploded,” Sadiqi said.

“I felt like a thunderbolt hit my head, like I got shot, like someone broke a beer bottle on my head. Right there, I just lost total control. After that, I don’t know, I don’t remember.

“I remember that everything goes silent. Everything goes silent and my ears — my ear is ringing and I see the gun in my hand and I know something went wrong. I know that something is not right.”

Surveillance video shown to the jury shows flashes — believed to be gunshots — that start 46 seconds after the car entered the parking lot.

Khatera died at the scene, while Mangal was taken off life support and died 10 days later. Sadiqi faces two counts of first-degree murder in what the Crown argues was an “honour killing” sparked by anger over the couple’s engagement.

Lawyers representing Sadiqi are expected to argue he was provoked.

Under questioning from his lawyer, Lorne Goldstein, Sadiqi said he never formulated a plan to kill his sister, that he had never thought about killing her nor Mangal, and that he never had specific intent to cause their death.

Tribal differences were not an issue and the killings were not done to provide cleansing, he said. Asked what killing his sister did to the honour of the Sadiqi family, Sadiqi replied: “Damage it.”

Sadiqi said he was saddened and ashamed by what he had done. He described being confused, shocked and scared after the shooting, and eventually turned himself in.

Sadiqi said he had not sought bail after being arrested because he wanted to take responsibility.

On Friday, the Crown wrapped up its case with testimony from one of Mangal’s brothers — who described Khatera’s joy at living with the Mangal family — before Sadiqi took the stand.
With his black hair slicked back and wearing a grey suit and light blue shirt unbuttoned at the collar, Sadiqi, 23, said he had been holding the gun and some ammunition for a friend of a friend since early 2006, for $500 per month.

He said he usually kept the gun in his home, but had it in his car, under the driver’s seat, because the friend of a friend had asked him to keep it close in case that person needed it, he said.

But when faced by repeated questions by assistant Crown attorney Mark Moors regarding details of the friends and the gun, Sadiqi refused to identify the people or location where he’d received the weapon, even when directed to do so by Ontario Superior Court Justice Douglas Rutherford.

The dishonour of honour: how a Canadian courtroom has supplanted it’s vitrue with sharia.

I’m certain many by now are familiar with the ongoing trial of Hasibullah Sidiqi, the now 23 year old man charged with two counts of first degree murder for the brutal slaying of his sister Khatera and her fiance in September of 2006. After a night out of dinner and a movie, the pair were gunned down as they sat in her car at the Elmvale Shopping Centre. Khatera was pronounced dead at the scene and Feroz Mangul died ten days later in hospital.

Hasibullah Sadiqi has been accused of the crimes and is on trial in a Canadian courtroom. This case is not one to determine Sadiqi’s guilt or innocence but one rather to determine whether or not his charge(s) could be whittled down to manslaughter, a ruling which would carry a lighter sentence. The defense will argue the complex issue of provocation on Mr. Sadiqi’s behalf essentially bringing forward sharia as a defensive measure, while the Crown will advance these murders as honour killings.

It is not unusual for a defense team to bring forward what many would deem repugnant defense arguments; in fact it is their job to defend their client to the best of their ability including introducing outrageous platforms. It is also not unusual to advance religious ideology or cultural tradition as a defensive measure to attempt to mitigate a sentence. In 2004 the B.C Court of Appeal heard a similar case of a man who murdered his wife for defying Sikh principles, ultimately to his loss. So then, we should not be entirely surprised that a Canadian court could now be entertained by such an open defense of sharia.

But having said that and not long ago, we were assured that sharia law in Ontario ( and by extension Canada) would be squashed. The provincial government loudly condemned such an outrageous prospect, an outcome guided mainly by Muslim women. Yet here we find a case before the court in full, frontal swing. While Mr. Sadiqi’s defense will attempt to deliver the notion of provocation, the Crown will denounce honour killing as morally bankrupt; a foreign practice anathema to Canadian values.  Underlying both arguments is the core issue which we can no longer stretch to avoid: sharia law is at play in Canada. Have we somehow normalized sharia by simply allowing the legal argument to proceed as a valid, defensive measure in the courtroom? Have we somehow legitimized a cultural absurdity and allowed a foreign ill to compete en par with our set values? Is this another awful end-result of a failing and out-dated multicultural project?

Consider this: Hasibullah Sadiqi came to Canada in 1986 with his parents from Afghanistan when he was five months old. Yet despite being raised in an environment of opportunity, equality and tolerance, he assumed the misogynistic watch-man post over his two sisters at the apparent grooming of his father. What was happening in Canada in 1986?– the World Exposition opened in Vancouver, Brian Mulroney was Canada’s 18th Prime Minister, Top Gun was the highest grossing film of the year and Madonna and the Vatican were at odds over Papa Don’t Preach. Pretty benign stuff. What was happening in Afghanistan in 1986? The continuation of age-old tribal feuding, war, corruption, oppression, violence, religious intolerance and the never-ending subjucation of women. Same old stuff.

Is this the proud heritage and loving legacy that Hasibullah’s father imported and imparted to his Canadian son? Is this the pious model by which Sadiqi chose to valiantly defend on September 19 only to end his sister’s life in it’s honour? Why didn’t Hasibullah assimilate to a country that would have gladly provided him every avenue for success, enrichment and freedom? Why would he betroth himself to a distant nation he never knew? Why was his sister’s healthy independance considered such a profound mark of distain to the family’s good sensibility that she would have to pay recompense with a bullet in her head?

Many questions, but perhaps all things considered it is time to ask. After all, it was this same “profound attachment to his heritage” as he has claimed, that was the motivating factor which led him to confront his ‘shameful’ sister and her fiance with a loaded .44 magnum. And it is this same attachment to cultural heritage that lawyers now find themselves either courting or denouncing in an Ottawa courtroom and the same imported legacy by which the public has the right and duty to openly scrutinize. If Mr. Sadiqi calls upon sharia as a cultural defense in a Canadian court, then surely Canadians would be within their purview to alternatively denounce sharia as a cultural offence.

Canadian law is specific; first degree murder requires a sentence of life in prison. We can argue as we have time time and again, that the system may be unjust through the provision of leniency via common plea bargaining. But we cannot afford to alter so readily the constitutional guarantee that all people are considered equal before the law, nor can we dismiss the disastrous outcome this specific case may indeed secure in it’s potential of creating a two-tier system. If the defense is successful on behalf of Sadiqi, our most cherished of values will have been demoted in a backward step toward a primitive rank.

Mr. Sadiqi’s attachment to  his Afghani cultural heritage does not deserve special consideration in a Canadian court any more than my Irish heritage does. If we are to uphold this most important of Canadian values, we can do nothing less than judge Sadiqi as we would any other Canadian. Khatera Sidiqi, Feroz Mangul and Canada deserve nothing less.

Ottawa Sun: Sadiqi ‘honour’ femicide trial.

From the Ottawa Sun May 16 2009

Hasibullah Sadiqi expressed a desire to “get rid of” his sister and her fiance weeks before he shot and killed the couple, one of his friends told a jury Thursday.

“He said, ‘I want to get rid of them,’ ” said Payman Fazli. “Then he said he was just joking.”

Sadiqi has pleaded not guilty to two counts of first-degree murder in the shooting deaths of his sister, Khatera Sadiqi, and her fiance, Feroz Mangal. The pair were shot and killed while sitting in their car in the Elmvale Mall parking lot just before 1 a.m. on Sept. 19, 2006.

Although Hasibullah Sadiqi doesn’t deny he is responsible for the deaths, his lawyers have said he rejects the Crown’s theory the shootings were an “honour killing” carried out by Sadiqi.

The Crown contends he murdered the pair because he felt his sister had dishonoured his family by becoming engaged to Mangal without her father’s permission, and by moving in with the man’s family, actions contrary to her family’s Afghan heritage. Sounded sad

Under cross-examination by defence attorney Lorne Goldstein, Fazli stood by his story he’d personally heard Sadiqi use the phrase “get rid of them” when speaking about what he wanted to do about the relationship between his sister and Mangal.

Fazli said it’s likely he’s the only person who heard Sadiqi say those words on two separate occasions weeks before the shootings.

Fazli also testified about meeting Sadiqi the morning after the killings at Fazli’s apartment building on Riverside Dr. “He wanted to see me. He sounded sad and upset,” said Fazli. “He said Khatera was gone. I said, ‘What do you mean?’ and he said, ‘Khatera is gone.’ ”

Fazli said Sadiqi then admitted he’d shot the couple.

“He asked me if I wanted to go to mosque to say a prayer for her,” said Fazli. “He said, ‘She’ll become a martyr. She’s in paradise now.’ ”

Near the end of Fazli’s testimony, the 22-year-old became emotional when he talked about having to come to court and talk about the killings.

“So many families want justice for Khatera and Feroz,” said Fazli. “Two lives are gone. Everyone is hurt by this.”

Earlier in the day, court also heard from Sultan Mangal, Feroz’s father, about the last time he spoke with his son.

Mangal said he called his son around 11:20 p.m. on the night of the shootings.

“I told him, ‘Why are you late?’ ” Mangal testified through a Pashto interpreter, frequently dabbing at his eyes with a tissue. “With a smile and a laugh he said, ‘I am on the highway. I’ll be shortly home.’ That was the last (of his) voice I heard.”
