Much has been said and written on the case of the alleged woman killer of Freiburg, an Afghan refugee who was already in prison for a similar crime in Greece. Ten years’ imprisonment was the verdict after he had thrown a young woman off a cliff.
However, after only one and a half years, he was released in October 2015 as part of an amnesty, with the requirement to report regularly to the police.
Instead, he soon disappeared to Germany. The Greek authorities announced a manhunt, but only within the country – the European Ministries of the Interior therefore had no information about him.
The Greeks did not release an international Arrest warrant
The alleged murderer of Freiburg is convicted in Greece because of a killing offense, Federal Minister of the Interior de Maizière said. He was identified with no doubt. He holds the Greek authorities in part to blame.
“Incompetence,” suggests Dimitris Papadimitriou, a Greek researcher at the University of Manchester. The purpose of the amnesty was to create space in Greece’s overcrowded prisons, by freeing mainly prisoners whose offenses were not particularly severe.
In the case of such less serious cases, it is not customary to alert international authorities if the person released, breaches his reporting obligation and disappears.
Rulebook slowdown? Or lack of attention?
Perhaps, according to Papadimitriou, the responsible authorities had just been “engaging in a rulebook slowdown”. As the perpetrator had been released in the context of an amnesty for less serious crimes, it was perhaps not deemed necessary to report to the partner authorities abroad. Or they just did not pay attention.
The man, however, had been sentenced to ten years’ imprisonment for attempted murder. Not a light offense, and Papadimitriou neither understands why the case was not reported to abroad, nor why the man was released at all.
The German Ministry of the Interior has announced that it would demand an explanation from the Greek authorities on their lack of activity.
The Ministry of Justice in Athens has justified its decision with “good conduct” of the prisoner. “Even with very good behavior, a release is normally only considered when at least half of the sentence has been served,” says Papadimitriou. In this case five years.

But the amnesty had reduced the threshold to 20 percent for prison sentences between three and ten years. A fifth of ten years – in this case, this would be two years. The perpetrator, according to media reports, had only served 1.5 years.

It came in October 2015, at the height of the refugee crisis. The reason, however, was probably a different one: the party-political dynamics within the left-populist Syriza government. “The left wing was still very strong in the party at that time”, says Syriza specialist Papadimitriou, “and a broad liberalization of the penitentiary system was a central theme for these forces.” They even tried to press the easing of detention conditions and lessening of penalties for Greek leftist terrorists, as well as the release of the imprisoned bomb maker of the terrorist group “17. November” Savvas Xiros.
Dangerous violent criminals were released.
So the amnesty resulted from idealistic ideas, not to get rid of prisoners in the direction of Germany, the researcher says. To some extent, the amnesty had even been a reasonable idea, but it went wayward fro ideological reasons and out of incompetence.
The later Freiburg suspect was not the only dubious beneficiary of the amnesty. The step had caused outrage among parts of the population, because dangerous violent criminals were also released.
One of them Vassilis Stefanakos, who is notorious in Greece, sentenced to several years of imprisonment (21 years, 14 years, 14.5 years) for several offenses ranging from aid to murder, extortion, and smuggling, to aiding the escape of a prisoner. He allegedly also cooperated with a terrorist group. He was released in this amnesty after serving only 8 years.
The courts are absolutely overwhelmed
Accordingly, opposition politicians criticized the amnesty sharply, and demanded that only perpetrators who had committed no violent crimes, and who no longer are a danger to the society, should be released early. It is unclear whether the Greek authorities will now review the files of the amnesties again, and report problems to the ministries of the EU.
The overcrowded prisons are not the only problem of the Greek justice. According to media reports, the courts are so overworked that it would take ten years to process all cases on record, even if no new cases were added on top. Several-month-long strikes of the judicial officials last year exacerbated the problem. According to media reports, the burden on the courts doubled in 2015 from 380,000 to 700,000 unprocessed cases.
In addition to that, Greece has by far not enough specialized lawyers to cope with the tens of thousands of asylum applications in the refugee crisis. Especially judges for second-instance proceedings are lacking. The EU had promised aid with personnel, but so far little has been achieved. Less than 100 lawyers from the EU have so far been sent to Greece to help with asylum procedures. Several hundred were promised.

One of which is there is evidence that the 17 year old Afghan boy who is accused of raping and murdering a German pro-refugee activists, was arrested tried and convicted 2 years ago in Greece for raping and attempting to murder a Greek girl, and sentenced to 10 years in prison, where he served only one, and then was released where he found his way to Germany.
He was also 17 at the time, 2 years ago.
We are working on translating the articles now about it. But if it pans out, it looks legit, it will make next years German Citizen of the Year Awards, a lot more difficult. Probably will require security.

Police and State Attorney Bochum invited to a press conference for Tuesday: reason is the arrest of a man, who commited both rapes at the university of Bochum.

The Case
In mid November, in Bochum a Chinese student was pulled into the bushes and abused. In August, a 21-year old student was raped in the same district. This victim was injured so severely that the police deployed the homicide division. “We cannot rule out that the perpetrator wanted to kill his victim”, said State Prosecutor Andreas Bachmann to Bild.
Experts used the victims’ statements to produce phantom pictures. A comparison of the DNA traces of the sex beast brought certainty: it is the same perpetrator.
The Chinese had described him as a foreigner of arab origin, and expressed the suspicion that he could be an asylum seeker. The police were preparing a mass DNA screening. It will be disclosed tomorrow if this solved the deed or if clues from the phantom pictures brought the breakthrough.
This news brings relief to the university. A speaker: “We were issuing warnings to female students on social media and student councils. Our security service offers help, for example I the evenings by walking people to their cars.”

Murdered student in Freiburg: a dyed hair led to a hot scent
After the murders in Freiburg, police arrested a 17 year old afghan refugee. His hairstyle revealed him. This case will be a matter for debate.

It was only Friday morning in Freiburg when Martin Jäger (Christian Democrats), Secretary of State in the Ministry of Interior in Baden-Württemberg, announced to send 25 additional police forces to the city which has been shaken by two sex killings.
At 12.30 pm on the same day, the police were able to arrest the alleged murderer of the 19-year-old medical student Maria L. in the Freiburg district of Littenweiler: a 17-year-old Afghan refugee living with the family; he had illegally come to the student town in southern Baden as a so-called “unaccompanied underage refugee” (UMA), in 2015.
In the night of October 15th to 16th, the medical student Maria L., daughter of a high-ranking, EU official, was raped near the Black Forest Stadium, and was found drowned shortly thereafter later in the river Dreisam. It remains to be clarified by further investigation whether she was unconscious and thrown into the Dreisam river after the rape, or if the murderer drowned her violently.
Unclear, if victim and perpetrator knew each other
The young woman was on her bicycle on her way back from the “Big Medi Night”, a party of the medical students, and was assaulted on the illumindated bicycle lane around 3:00 o’clock in the morning.
Police searched the crime scene thoroughly and had the branches of a blackberry bush on the banks of the river Dreisam cut and analysed. In the hedge, the investigators found an approximately 18.5 centimeter (7.3 inches) long hair. “It was this optically striking hair in the thorn bush that caught our attention“, says Müller.
The dyed hair was the basis of further research. Over several days, criminal investigators analysed the video recordings from the street tram line 1, which leads to the vicinity of the crime scene. Video recordings with a volume of 13 terabytes had to be sifted. The officers noted a young man with an “undercut haircut”, who had dyed one braid. “After the technical review of the video recordings, the man could then be screened and checked on December 2,” said Müller.
It is still unclear whether the refugee met his later victim accidentally at the river Dreisam, or whether he knew the medical student. It still needs to be ascertained whether there is a connection to the murder of the jogger Carolin G., who had been raped and murdered in broad daylight on a path in the vineyards at the beginning of November in the town of Endingen, Kaiserstuhl. Until now, the investigators can not see any connection, the course of events are said to have been very different, and there is currently no utilisable DNA material. In the region – and especially in the social networks – rumors are circulating that it could be a serial killer. There is no proof for this.
Politicians have been demanding more police in Freiburg for years
The murders in Freiburg have also led to a political discussion about the personnel staffing of the police and investigation impediments in the analysis of DNA traces. Police have been demanding a better staffing of the police in Freiburg for almost ten years. The 2004 Criminal Procedure Code states: “In the investigation, it is not allowed to draw any findings other than those required to identify the DNA identification pattern as well as the sex.” Justice Minister Wolf advocates to utilize “all constitutional approaches ” in the future. The “Bund Deutscher Kriminalbeamter” (German Confederation of Criminal Investigators) also considers the existing regulation to be no longer up-to-date.
In Freiburg, there have for quite some time been problems with underaged unaccompanied foreigners, who are cared for by the youth aid of charitable institutions. There have been occasional sexual harassments. This group of refugees has repeatedly stood out with battery and drug dealing at the Stühlinger Kirchplatz near the Train Station. Also in this respect, this case will provide material for debate.
