  1. CANADA – Mentally ill, found guilty of terrorism: What happens to Chiheb Esseghaier?

A Toronto courtroom Wednesday will debate the fate of a man found guilty of serious terror charges but who suffers from a mental illness so severe he may not be fit to be sentenced and may not even be criminally responsible for the crimes he committed.

A jury found Chiheb Esseghaier and his co-accused Raed Jaser guilty of multiple terror charges, including conspiracy to commit murder, this past spring. Since then, however, an experienced forensic psychiatrist found Esseghaier to be “actively psychotic,” likely schizophrenic and unable to participate in court proceedings.

Lisa Ramshaw’s testimony earlier this summer derailed the high-profile Via terror trial, forcing those involved — and those following the story in Canada and abroad — to question how the justice system and a society ought to deal with someone found guilty of serious crimes even as he suffered serious illness.

Over the course of several years, Esseghaier went from being a promising graduate student to effectively homeless and, according to his fellow students, increasingly erratic as he espoused more extreme religious views.

Ramshaw told the court Esseghaier spent several years in a worsening spiral of schizophrenia.

“It’s not rare,” Ramshaw told Global News, for people in that state “to gravitate toward religion to feel better.”

Over the the course of the trial Esseghaier has communicated his contempt for “man-made” law, his intention to convert those in court to Islam prior to a pending apocalypse and an antipathy toward the number three.

Justice Michael Code made clear he doesn’t agree with Ramshaw’s assessment, at least not with her finding that Esseghaier isn’t fit.

So he ordered a second assessment, conducted by forensic psychiatrist Phil Klassen. Klassen will present his assessment to court Wednesday morning.

Even if he finds Esseghaier fit to be sentenced — and Code made clear last month he expects as much — this case is still in uncharted legal waters.

Esseghaier has no lawyer because he insisted on representing himself. But a court-appointed “amicus curiae,” Russell Silverstein and Ingrid Grant, could still ask Code for an assessment determining whether Esseghaier was criminally responsible when he was conspiring to blow up a train.

Or they could ask Code to have Esseghaier hospitalized and treated.

Whatever happens, questions around Esseghaier’s mental state have implications not only for his fate, but for that of his co-accused: Jaser’s lawyer could very well question the legitimacy of his client’s trial and guilty finding, given that the person with whom he supposedly conspired may have been too sick to do any conspiring.

Jaser’s lawyer John Norris has called the case “utterly unprecedented.”

These uncomfortable questions come up as terror investigations in both Canada and the U.S. are coming under fire for their alleged targeting of vulnerable people. The FBI, whose undercover agent played a seminal role in the Via terror investigation, has come under fire from Human Rights Watch for a series of prosecutions that targeted individuals with severe mental illness.

“We’ve documented cases of the FBI knowing someone suffered from a mental illness and continuing to pursue them anyway. … The same sorts of allegations are popping up in the Canadian cases,” said Human Rights Watch deputy Washington director Andrea Prasow.

    • Would-be terrorist Chiheb Esseghaier is clearly insane, but should that even matter in court?

[…]In a ruling handed down July 13, Code did his best to slam that door shut. In a fiery decision delivered with something near hostility, he vehemently rejected the idea that Esseghaier should not have been allowed to make his own decisions in court.

“In my view there is not a scintilla of evidence from the pre-trial or trial record to suggest that he was unfit to stand trial nor did anyone raise the matter at trial and suggest otherwise,” he said.

In the end, the judge rejected virtually all Ramshaw’s findings, calling her report “unsatisfactory” and worthy of “little or no weight.” At the joint urging of the Crown and the amicus, he ordered a second psychiatric review by a new doctor. Complicating that examination, though, is the fact that Esseghaier, who angrily rejects the idea he might be sick, has refused to participate, meaning psychiatrist Philip Klassen will be forced to rely entirely on the written record.

Baillie found Code’s reaction to Ramshaw’s report “perplexing.” Ramshaw, he said, was “responding to an individual who has lost grip with reality and is facing some pretty significant symptoms.”

But even if Esseghaier was and is insane, that doesn’t mean he was necessarily unfit to stand trial or, for that matter, not criminally responsible for his actions. The legal test for both is strict in Canadian law. It’s not enough just to be crazy. And Esseghaier’s lawyers, if he had had them, would have had a tough time proving either.

There are also plenty of mentally ill terrorists, says Paul Gill, a senior lecturer in security and crime science at the University College London. In a recent study, he found 40 per cent of lone-actor terrorists suffered from some kind of mental illness and 40 per cent of those were diagnosed schizophrenics.

“And just because they had histories of mental illness doesn’t make them irrational, spontaneous actors,” Gill said. “Many of them, they were just as likely to engage in really rational, thought-out planning as the guys without mental health problems were.”

The issue in Esseghaier’s case is that it seems entirely possible no one will even have the chance to make that argument. Code’s ruling made his views more than clear. He believes Esseghaier’s decisions in court stemmed from his religious beliefs and were always coherent and rational. And if Esseghaier was fit to stand trial, he was fit to make his own decisions, including the choice not to offer a defence or raise the possibility he was not criminally responsible.

  2. US swoop on secret ‘steroids labs’ with China links (BBC, Sep 2, 2015)
    http://www.bbc.com/news/world-us-canada-34123490

“US agents have arrested more than 90 people and shut down 16 underground labs making illegal steroids and other performance-enhancing drugs.

The Drug Enforcement Administration (DEA) said hundreds of kilos and thousands of litres of chemicals were seized in 20 states over five months.

Operation Cyber Juice focused on secret laboratories dealing in drugs obtained over the internet from China.

Agents also confiscated steroid powder, liquid and more than $2m in cash.

DEA spokesman Chuck Rosenberg said too many young people were ruining their bodies and lives through steroid abuse, but this operation had attacked the “global underground steroid market, exposing its dangers and lies”.

It began in April and ended with nine arrests on Tuesday….”

  3. New Ebola death confirmed in Sierra Leone (BBC, Sep 1, 2015)
    http://www.bbc.com/news/health-34121973

“A woman who recently died in northern Sierra Leone has tested positive for Ebola.

It comes as a setback to the country’s effort to eradicate the deadly disease.

Sierra Leone was celebrating last week when it discharged its last known Ebola patient from hospital.

News of the new case means the country is no longer Ebola-free. High-risk contacts of the woman have been identified, isolated and will now be watched for symptoms.

The National Ebola Response Centre is assessing whether to isolate the whole village of Sella in the Kambia district where the woman, who was in her mid-60s, died.

The end of the outbreak will only be declared six weeks after the last Ebola patient either dies or tests negative for the virus.

At the height of the outbreak, Sierra Leone was reporting more than 500 new cases a week.

Meanwhile, in Guinea there were three confirmed cases in the week up to 23 August.

The last known Ebola case in Liberia was discharged on 23 July.”

  4. Nigeria to start using drones to fight oil theft (BBC, Sep 1, 2015)
    http://www.bbc.com/news/world-africa-34121855

“Nigeria is to deploy drones to monitor the movement of ships in an effort to curb the rampant oil theft in the country, the state oil firm says.

Nigerian National Petroleum Corporation (NNPC) says it wants to end crude theft in the next eight months.

Nigeria is Africa’s biggest crude producer but its revenue is severely reduced by theft and attacks on oil pipelines.

New President Muhammadu Buhari has vowed to clean up the industry.

Oil generates around 70% of government revenues in Africa’s biggest economy.

But a 2013 report by think tank Chatham House said that 100,000 barrels per day were being stolen.

That was equivalent to 5% of Nigeria’s daily production.

It said the theft was occurring on an “industrial scale”, with small barges transferring stolen oil to tankers waiting offshore to take it to international markets.

Senior politicians and military officers are said to be involved in the illegal trade.

The new head of NNPC Ibe Kachikwu also said the company would work more closely with Nigeria’s navy to tackle the problem.”

  6. Yemen crisis: ‘Serious abuses’ against Aden detainees (BBC, Sep 2, 2015)
    http://www.bbc.com/news/world-middle-east-34118025

“Pro-government militiamen and Houthi rebels have committed serious abuses against detainees in Yemen’s second city Aden, Human Rights Watch says.

The US-based group alleges southern militias have summarily killed at least seven Houthi prisoners since March.

In one case, a rebel was beaten in a public square before being shot dead.

The rebels are accused of unlawfully detaining and mistreating civilians before they were driven out of Aden in July after months of fierce fighting.

Southern fighters, backed by a Saudi-led coalition seeking to restore Yemen’s exiled president, have advanced northwards since then, creating a security vacuum that has reportedly been filled by jihadist militants from al-Qaeda and Islamic State (IS)…”

  7. Migrant crisis: Thousands arrive in mainland Greece (BBC, Sep 2, 2015)

“Thousands of migrants are arriving in mainland Greece as the government prepares for talks on tackling the huge number of people reaching its shores.

Two ships carrying more than 4,200 people travelled to Piraeus port at night after leaving Lesbos island.

The whole EU is struggling to deal with an unprecedented influx of migrants.

Hundreds of people, mostly from the Middle East, remain stranded outside a railway station in Hungary after police stopped them travelling through the EU.

The EU’s border control agency, Frontex, says 23,000 migrants arrived in Greece last week alone – an increase of 50% on the previous week…”

  8. Saudi Arabia refuses to bow to pressure to cut oil production (msn, Sep 2, 2015)
    http://www.msn.com/en-us/money/markets/saudi-arabia-refuses-to-bow-to-pressure-to-cut-oil-production/ar-AAdQDll

“Market share continues to be Saudi Arabia’s main concern—and not even $40 oil prices will make it give into peer pressure to cut production.

Major oil producers have been trying to convince Saudi Arabia, the Organization of the Petroleum Exporting Countries’ biggest producer, to take the lead and cut production to stem the price declines.

But output from the nation instead climbed to about 10.45 million barrels a day in July from 10.1 million in April, according to an estimate from Platts, even though West Texas Intermediate and Brent oil prices are down roughly 15% year to date on the back of a global supply glut.

Venezuela has asked OPEC to hold an emergency meeting and to consider a coordination with non-OPEC Russia to discuss a strategy to stem the recent oil-price rout, The Wall Street Journal reported last week.

Other OPEC members, including Iran, which is set to boost production as sanctions on the country are eased in the wake of a nuclear agreement with the West, have also reportedly pressured the Saudis to lower their output.

Oil prices will move higher if Saudi Arabia makes a sacrifice and cuts its own production—and that would benefit every other producing nation, said Patrick Kerr, owner of private-investment firm The Kerr Organization….”

    http://www.msn.com/en-us/news/world/us-launches-secret-drone-campaign-to-hunt-islamic-state-leaders/ar-AAdR2UH

“The CIA and U.S. Special Operations forces have launched a secret campaign to hunt terrorism suspects in Syria as part of a targeted killing program that is run separately from the broader U.S. military offensive against the Islamic State, U.S. officials said.

The CIA and the Joint Special Operations Command (JSOC) are flying armed drones over Syria in a collaboration responsible for several recent strikes against senior Islamic State operatives, the officials said. Among those killed was a British militant thought to be an architect of the terrorist group’s effort to use social media to incite attacks in the United States, the officials said.

The clandestine program represents a significant escalation of the CIA’s involvement in the war in Syria, enlisting the agency’s Counterterrorism Center (CTC) against a militant group that many officials believe has eclipsed al-Qaeda as a threat…”

Four survivors – some of whom are in a critical condition – are in hospital.

The cause of the fire in the building, located at the foot of the famed Montmartre hill, is being investigated.

Interior Minister Bernard Cazeneuve said it was “too early to determine the causes of this tragedy”, according to the AFP news agency.

      http://abcnews.go.com/International/wireStory/iranian-hard-liners-unveil-anti-us-plaque-embassy-33474853

“More than a dozen hard-line Iranian students have unveiled an anti-American plaque at the gate of the former U.S. Embassy in Tehran.

The plaque unveiled Wednesday by the Basij paramilitary forces carries a list of condemnations of America uttered by the Islamic republic’s late founder, Grand Ayatollah Ruhollah Khomeini. During the gathering, the students set fire to U.S., British and Israeli flags.

Iran and the U.S have had no diplomatic relations since 1979, when Iranian students stormed the embassy and took 52 Americans hostage for 444 days.

Hard-liners in Iran have stepped up displays of anti-American fervor since the signing of a landmark nuclear agreement with Washington and five world powers last month.”

  17. We who are facing an existential crisis. The BBC and other juornos are not capable of thinking beyond the next headline..

If these mostly young males, well equipped by their families, make it, then they will send for their families. We are looking at millions, even tens of millions, every year, as family re-unification kicks in. Good bye Christian Europe and hello Sharia.

The reality is that these migrants do not wish to live in Turkey, a reasonably civilised Islamic country and a fellow Islamic country. No culture clash then.

In essence these Muslium migrants are fleeing from Islam. However, once safely ensconced in the West, they will conveniently forget what made them flee, assign false narratives about Islam, and then continue the Jihad in the West, as mandated by the Koran. By then Sharia will come about by normal electoral process, with some slaughter and blood, as the Koran warrants that conquest can be sealed only by blood.

  18. BBC – Radicals: ‘I’m not radical, I speak truth’ – BBC News ( 11 min ) Anne Marie Waters, from Sharia Watch, regularly criticises Islam and is organising a Prophet Muhammad cartoon exhibition. She says she is not a radical but “simply telling the truth”. “If there ever was a time to defend real freedom of speech it is now. People are being killed all over the world over this,” she adds. Islamic scholar Sheikh Haitham al-Haddad openly criticises homosexuality. He has been called a bigot, a hate preacher and has had talks at a number of UK universities postponed or cancelled. “I am just vocal about anything I disagree with. My view about homosexuality is clearly stated in the koran. If the media had a fair presentation of my views it would just not single out those points,” he says. The interviews were part of a series of reports by Catrin Nye about radicals.

The pundits are talking about how the Chinese don’t understand economics, since they are pushing Keynesian economics and are ignoring how the worlds economy is so closely tied together that China collapsing is going to really hurt others they need remedial education in real live economics rather then living in the fantasy world of the ivory tower pseudo intellectuals.

  20. Denmark to Review Some Naturalization Applications (abcnews, Sep 2, 2015)
    http://abcnews.go.com/International/wireStory/denmark-review-naturalization-applications-33480029

“In a move to further tighten immigration laws, Denmark’s integration minister said Wednesday she wants to review thousands of applications for naturalization from people who had been exempted from the mandatory Danish language test because of war-related traumas.

Integration Minister Inger Stoejberg, an immigration hardliner with the center-right Liberal government, said Danish citizenship is something that “one has to work for” and too many got it “via dispensation.”

The one-party minority government has the backing, among others, of the populist Danish People’s Party, which wants tougher citizenship requirements. Immigration officials told 255 people in May that tougher requirements might be applied retroactively should there be a new government after the June 18 elections.

This week, Stoejberg said 2,500 more applications of naturalization must be reviewed. Normally Parliament passes laws twice a year to give citizenship in votes considered a formality, and the next vote was scheduled in October.

The center-right bloc won parliamentary elections in June, negating a previous bill that said more than 3,300 people were to be naturalized as Danish citizens. In Denmark, law proposals are automatically annulled when there are elections.

The left-leaning opposition and human rights groups called Stoejberg’s decision a violation of international conventions.

“The government’s maneuver is nuts,” said Pernille Skipper of the left-wing Unity List. “(These people) had been granted an exemption because they have a disability or post-traumatic stress” disorder.

On Tuesday, a new law entered into force lowering the social benefits of asylum-seekers in the Scandinavian country.

In 2014, 15,000 people sought asylum in Denmark, twice as many as in 2013. So far, 14,793 people have sought asylum during the first seven months of 2015.”

  21. Norwegian bank prints anti-Semitic portrait on credit card

Offensive card showed a tallit-clad, long-nosed figure in front of a background of gold coins; bank claims it was the result of service allowing clients to design their own cards.

The card, featuring a long-nosed Jewish figure wearing a tallit, with gold coins in the background, caused uproar online.

The man who ordered the offensive Visa card is an Australian citizen living in Norway. He claims that when he got the card he was surprised to find out that its design didn’t match his order.

The issue was brought to the attention of the Israeli Embassy in Oslo, which reached out to the bank’s management, which promptly apologized to the ambassador, explaining that the bank has a system that enables clients to order personally designed cards, with portraits or pictures on them.

DNB claims that it has a mechanism for filtering out offensive images, but the anti-Semitic portrait somehow got past it. The bank explained that it issues a few million cards every year, noting it was an isolated incident, and that the picture was deleted from its database.

The bank’s vice president said he was surprised to hear from the Israeli Embassy saying the client received the offensively-pictured card without requesting it himself.

He asked for the forgiveness of anyone who was offended and stated that the bank intends to issue an explanation and apology notice.

After the incident was publicized, the bank announced that the card in question would be cancelled, and a new one issued for its owner.

Its representative stated that the bank has strict guidelines about which photos can be uploaded, and that supervision is done manually. Unfortunately, he said, manual supervision failed in this specific case. He said that the card shouldn’t have been printed under any circumstance.

  22. GRECE – 4,300 migrants arrive in Athens as govt holds crisis talks

The Greek government was set to hold talks Wednesday on the huge numbers of migrants landing on its shores, as some 4,300 more people arrived in Athens overnight, most of them Syrian refugees.

Two ships carrying the latest arrivals docked at Athens’ Piraeus port after sailing from Lesbos, one of several Greek islands struggling to cope with the huge waves of people crossing the Mediterranean from Turkey in flimsy boats.

Some 1,800 people arrived on the Greek mainland on Tuesday evening, with another 2,500 landing at dawn, port police said, adding that they had been taken to a nearby train station.

The ships were chartered by the Greek government to help relieve pressure on Lesbos, whose authorities and infrastructure are ill-equipped to deal with the huge influx of people.

More than 160,000 people have arrived in Greece this year, most of them fleeing war in the Middle East, as Europe grapples with its biggest migration crisis since World War II.

For many, Athens will be merely the first stop in a gruelling land journey north through the Balkans in a bid to reach Hungary, a key entry point into Europe.

The numbers crossing from Turkey to Greece have soared over the summer as the migrants, many paying over $1,000 to smugglers for the risky passage, take advantage of the calm seas to make the crossing.

The Greek government — which has just accepted a third international bailout as it struggles to pay enormous debts — has repeatedly said it is unable to cope with the scale of the influx, calling for a coordinated European response and for more resources to help it tackle the crisis.

Greek ministers were set to meet Wednesday morning on the crisis, which is likely to be at the centre of talks scheduled Thursday in Athens between Greek officials, the European Commission’s vice-president Frans Timmermans, and Dimitris Avramopoulos, the EU’s Migration and Home Affairs Commissioner.

  23. YEMEN At least 20 killed in explosions at mosque in Yemeni capital: officials

Medical officials say at least 20 people have been killed by two bombs that blew up at a mosque in the Yemeni capital, Sanaa.

Police officials say a suicide bomber blew himself up Wednesday inside the mosque during the evening call to prayers, while a car bomb exploded outside the mosque’s door. Medical officials say the death toll may rise with people now in operating rooms in several hospitals.

Witnesses say the car bomb exploded while people were carrying out the wounded from inside the mosque.

  24. USA – Sheriff defends warning about Islam; Muslim civil rights group condemns his remarks

A national Muslim civil rights and advocacy organization on Tuesday spoke out against Hamilton County Sheriff Jim Hammond’s claim Monday that Islam is “communism with a god” and a threat against constitutional government.

The Council on American-Islamic Relations asked state and federal officials to step up protection of Tennessee Muslims in light of Hammond’s comments. On Monday, Hammond urged other Tennessee sheriffs to keep a close eye on Islamic activity, and he claimed federal officials are ignoring “the strongest infringement that we’ve had in our country as a constitutional government since communism.”

Ibrahim Hooper, CAIR’s national communications director, called the sheriff’s statements disturbing.

“When you’ve got sheriffs who are supposed to serve and protect all citizens of the state and county, and basically they’re saying they’re going to monitor law-abiding citizens based solely on their faith, and that Muslims are trying to take over the country, these are the kinds of statements you heard in pre-war Germany about another minority faith community,” Hooper said.

Hammond contended he was only referring to radical, extreme Muslims, not the entire religion. He defended his comments Tuesday, arguing that they were not “derogatory in any way.”

“I’m against anybody — Muslim, Buddhist, Christian or otherwise — who wants to remove the Constitution of the United States and wants to install religious law,” Hammond said. “I have just as much of an obligation to protect Muslims [as any other citizen], as long as they are not trying to be subversive. And there are a lot of good Muslims who are not. They have nothing to worry about.”

Still, Hooper said he’d like to see some sort of formal condemnation of Hammond’s attitude from state and federal leaders.

“We shouldn’t have to ask for these things, but it seems we have to,” he said. “What are the appropriate actions? These officials need to decide — but they need to address this growing trend directed at American Muslims.”

Hammond said he’s not surprised the national organization spoke out against his comments.

“I would expect nothing less,” he said. “One of the first things they do is try to instill fear to keep people from saying the truth.”

Hammond made his initial comments to the Hamilton County Pachyderm Club during a speech Monday on domestic terrorism.

  25. STERLING HEIGHTS – Controversial comments about proposed mosque by Sterling Heights mayor draw fire

STERLING HEIGHTS, Mich. (WXYZ) – Controversial comments by the mayor against the building of a Muslim mosque are drawing further criticism in Sterling Heights.

Mayor Michael Taylor hopes to set the record straight about his comments.

However, civil rights advocates aren’t backing down.

Taylor is defending his name and reputation in the wake of the controversy.

Earlier today, the Michigan chapter of the Council on American Islamic Relations called Mayor Taylor’s opposition to a proposed mosque “improper”, saying it comes in the midst of anti-Muslim comments made by others.

The proposed site for the mosque is on 15 Mile Road.

The mayor tells us any objections on his part, which were posted on social media, are strictly based on a building being too tall or large for the area.

Recent hateful comments made by some and even a recent protest speaking out against a possible mosque have civil rights leaders worried.

On September 10th at 7 pm, the planning commission will meet to discuss the mosque proposal.

Video: CAIR-MI Rep Says Mayor’s Opposition to Mosque Could Influence Planning Commission

    Wednesday, September 2, 2015

FARMINGTON HILLS, MI — The Michigan chapter of the Council on American-Islamic Relations (CAIR-MI) today expressed concern over the “improper” opposition by the Mayor of Sterling Heights to a proposed mosque in that city.

In a recent Facebook post, Sterling Heights Mayor Michael Taylor stated, “I am opposed to this mosque being built on 15 Mile Road.”
Taylor also made references to terrorists abroad in his post.

His opposition comes in the midst of recent anti-Muslim comments by residents, which have been made in two city government meetings and coincide with an anti-mosque protest of more than 200 people opposed to the proposed mosque. A planning commission hearing for the proposed mosque is set for September 10 at 7 p.m.

“Mayor Taylor’s public opposition to the mosque not only calls into question his commitment to the civil rights of all residents of Sterling Heights but also his potentially wielding improper influence in upcoming proceedings relating to the mosque’s zoning,” said CAIR-MI Executive Director Dawud Walid.

Walid also noted that CAIR-MI has contacted the Department of Justice (DOJ) mosque opposition in Sterling Heights as it relates to the potential violation of the Religious Land Use and Institutionalize Persons Act (RLUIPA).

CAIR is America’s largest Muslim civil liberties and advocacy organization. Its mission is to enhance the understanding of Islam, encourage dialogue, protect civil liberties, empower American Muslims, and build coalitions that promote justice and mutual understanding.

  26. Making refugees welcome: Citizens of Germany, Iceland show the way (CNN, video, Sep 2, 2015)
    http://edition.cnn.com/2015/09/02/europe/europe-migrants-welcome/index.html

“While Europe’s politicians flounder in the face of an unprecedented wave of refugees and migrants seeking shelter — many of them from war-torn Syria — some individuals have decided to take matters into their own hands.

Using digital means, they are taking practical steps to offer desperate men, woman and children a place to stay in their own homes, or seeking to pressure their own governments into offering sanctuary to more of those in need.

In Iceland, author and professor Bryndis Bjorgvinsdottir has set up a Facebook page to call for her country’s government to increase the number of refugees it was planning to accept from a reported 50 — prompting a big response and wide media interest.

And in Germany, a website has been running for months which aims to match offers of accommodation in private homes — ideally shared rental apartments — across the country with individual refugees in need of a place to stay.

The website, Refugees Welcome (Fluechtlinge Wilkommen,) has already placed dozens of refugees who otherwise might be placed in overcrowded migrant centers or struggle to put a roof over their heads at all.

Such direct action couldn’t be more needed….”

  27. National Post – VIA rail terror plotter Chiheb Esseghaier likely mentally ill, but not unfit for sentencing: psychiatrist

One of the two men convicted in a terrorist plot to derail an Ontario passenger train is likely mentally ill but not unfit to be sentenced, a forensic psychiatrist testified Wednesday.

Chiheb Esseghaier has “psychotic symptoms” suggestive of schizophrenia, Dr. Philip Klassen told the court. However, Klassen said he does not believe Esseghaier is unaware of the court proceedings or potential consequences of his trial.

Esseghaier and a second man, Raed Jaser, were convicted in March of conspiring to blow a hole in a railway bridge at the behest or direction of a terrorist group, among other charges. Both men face the possibility of life in prison.

Esseghaier largely refused to participate in the court proceedings after his demand to be tried under Koranic law was denied. He often appeared in court in a faded ski jacket and spoke erratically through missing teeth and a long, ratty beard.

After his conviction, a forensic psychiatrist examined Esseghaier extensively. Dr. Lisa Ramshaw found him to be actively delusional — he believes among other things that prison guards and other prisoners are making a movie about him — and she concluded that he is likely schizophrenic and legally unfit.

The judge in the case, however, dismissed that report. In a heated ruling delivered in July, Superior Court Justice Michael Code said there was not “a scintilla of evidence from the pre-trial or trial record to suggest (Esseghaier) was unfit to stand trial.”

Code ordered a second psychiatric review, to be conducted by Klassen.

That order was complicated by Esseghaier himself, however. He angrily denies any suggestion that he is mentally unwell and vowed in July not to participate in a second examination.

As a result, Klassen was forced to rely on Ramshaw’s interviews, as well as court files and transcripts to come to his diagnosis.

In his testimony Tuesday, Klassen said he mostly agreed with Ramshaw’s medical opinion. Esseghaier, he said, had “psychotic symptoms” that don’t fit perfectly into any one diagnosis but are suggestive of schizophrenia. He disagreed with her legal view, though. “I am not persuaded that he is unfit,” Klassen said.

Much of Klassen’s testimony Wednesday morning revolved around a key question: whether Essghaier’s descent into radicalism was caused by or merely coincided with the onset of his mental illness.

“It could simply be that this man became radicalized and then became unwell,” Klassen said. But it could also be that the severe change in his behaviour was caused by the onset of his mental illness. “I don’t think I have a very clear sense of this,” Klassen said.

In any case, Klassen told the court that, based on the court transcripts and other evidence, he believes Esseghaier was suffering from psychotic delusions by at least January or February of 2015. His trial began in early February.

The sentencing hearing is scheduled to last until Friday.

CBC- Esseghaier mentally ill but fit for sentencing, psychiatrist tells court

The second psychiatrist to assess the mental state of a man found guilty in a terror plot to derail a passenger train says he likely suffers from a mental illness.

But Dr. Philip Klassen adds he nonetheless thinks Chiheb Esseghaier is fit to be sentenced.

Esseghaier and his co-accused, Raed Jaser, were found guilty in March of a terror-related conspiracy to commit murder – which carries a sentence of up to life in prison — and six other terror-related charges between them. Their sentencing hearing is currently under way.

During their last court session in July, the Toronto judge presiding over the case ordered a second mental health assessment for Esseghaier after concluding that an earlier one had “serious flaws.”

In that first assessment, Dr. Lisa Ramshaw said she believed Esseghaier was unable to participate in his sentencing hearing because he is likely schizophrenic.

Klassen is testifying that he also thinks Esseghaier is likely schizophrenic but, unlike Ramshaw, believes Esseghaier understands the nature of his court proceedings and is fit to be sentenced.

Klassen also noted that his assessment had to be conducted without interviewing Esseghaier because the man refused to meet with him. He based his assessment on court documents, interview transcripts and Esseghaier’s previous mental health assessment.

Esseghaier, who is self-represented, is deeply religious and has consistently maintained his desire to be judged under the Qur’an.

He has gone on rambling rants in the courtroom and even prayed in the prisoner’s dock, but his mental state only became an issue in the case after Ramshaw’s assessment was presented in court.

Esseghaier called her diagnosis a bunch of “lies.”
