  1. Lower courts bases their case on precedence of the law. They cannot our shouldn’t rule directly on the constitutionality.

    In other words if the lawyer only used “constitutional right” as an argument he is inept

  2. Thinking about this. I can not remember a time when cops were required to attended a religious organization of any kind unless it was a call of some sort or some kind of trouble.

    On the other hand Cops portal streets to show the presence this may not have been a bad order if he it wasn’t called Islamic Appreciation Day it wouldn’t have been so offensive. Showing their presence isn’t such a bad idea considering the crime rates Islam inflicts on society

  3. OxAO the constitution is the basis of our entire legal system, the lower courts can and have ruled on the constitutionality of various laws and actions, their refusal to do so here is a clear violation of their oath of office.

  4. They rule on what other court rulings not directly off the constitution.
    The constitution are guide lines to create law. The actual law transcribed from the constitution is the US code.

    This is why the courts never took the Obama citizenship issue. It was never transcribed into the US code for some odd reason. Thus technically it isn’t law. There was a ruling on it in the 1800’s but it wasn’t cut and dry.

    I read through this cases a little he based his case off of freedom of religion which is part of US code without another case to back it. This gives the judge way to much wiggle room to do whatever he wants.

  5. Ah, you are talking about Canadian courts, in the US the lower courts can rule on the Constitution, and be overruled if they get it wrong.

  6. The wiggle room started in the early 1900s when Judges started inserting their own beliefs into the Constitution instead of ruling on what was written, this is where most of the US legal and cultural trouble comes from.
