Reader’s inks for May 10th, 2024

Each day at just after midnight Eastern, a post like this one is created for contributors and readers of this site to upload news links and video links on the issues that concern this site. Most notably, Islam and its effects on Classical Civilization, and various forms of leftism from Soviet era communism, to postmodernism and all the flavours of galloping statism and totalitarianism such as Nazism and Fascism which are increasingly snuffing out the classical liberalism which created our near, miraculous civilization the West has been building since the time of Socrates.

This document was written around the time this site was created, for those who wish to understand what this site is about. And while our understanding of the world and events has grown since then, the basic ideas remain sound and true to the purpose.

So please post all links, thoughts and ideas that you feel will benefit the readers of this site to the comments under this post each day. And thank you all for your contributions.

This is the new Samizdat. We must use it while we can.

  1. Missouri AG Demands DOJ Release Communications with Soros Funded DAs Alvin Bragg, Letitia James, and Fani Willis Over ‘Witch Hunt’ Against President Trump
    by Jim H?ft May. 10, 2024 7:15 am624 Comments

Missouri Attorney General Andrew Bailey has formally requested that the U.S. Department of Justice (DOJ) release all communications involving Manhattan District Attorney Alvin Bragg, New York Attorney General Letitia James, and Fulton County District Attorney Fani Willis in relation to the “witch hunt” against former President Donald Trump.

    For context:

Alvin Bragg (Manhattan DA): The focus has largely been on alleged financial crimes, including possible fraud and falsification of business records related to hush money payments and other financial discrepancies within the Trump Organization.
Letitia James (New York AG): James has pursued civil charges against Trump and his business practices, alleging persistent fraud involving banks, tax authorities, and insurance companies. This includes misrepresenting the value of assets for financial gain.
Fani Willis (Fulton County DA): Willis is investigating alleged criminal interference in the 2020 presidential election.

In a series of tweets, Bailey cited evidence suggesting that the DOJ, under Biden’s regime, orchestrated or coordinated the prosecutions of Trump.

He pointed to the appointment of Matthew Colangelo, the third-highest ranking official in the DOJ, to the Manhattan District Attorney’s Office in December 2022 as a critical sign of coordination. Colangelo was brought on specifically to prosecute Trump.

Attorney Mike Davis also said this during an interview with Steve Bannon that Matt Colangelo is the link between the Biden DOJ and DA Bragg in their corrupt acts of targeting and putting together a bogus indictment against President Trump. This guy was in the Obama White House and the Biden DOJ and appears to have been brought in to indict President Trump on whatever he could come up with.

It’s hard to describe what a total sh*tshow the DC federal courthouse will become if/when SCOTUS reverses 1512(c)(2) for J6ers.

DC appellate court keeps putting on hold appellate proceedings in multiple cases pending SCOTUS decision. This motion granted Wednesday.

What this means is if SCOTUS rules against DOJ, a flood of motions to dismiss the count in pending cases, vacate existing convictions, and resentence/release J6ers imprisoned on the count.

More than 350 now charged with 1512(c)(2) and DOJ brazenly continues to bring the count against J6ers including a woman from California this week.

And it’s even harder to describe the gratification I will feel watching these judges eat it day after day.

The miasma of anxiety befogging so many brains in our troubled land begins to lift as every narrative served up by the US fascist intel blob goes annoyingly stale and impotent. The worst media meme — that a vicious officialdom is “defending our democracy” — gets laughed out of the room now when repeated incessantly by such shills as Jen Psaki and Lawrence O’Donnell of MSNBC. Everybody understands they want to “defend our democracy” by cancelling your freedom of speech, pounding you into bankruptcy, and stealing whatever remains of your stuff.

Likewise, everything else, namely: that our doings in Ukraine are a “fight for freedom,” that “white supremacy” lurks just out of sight getting ready to pounce on the “marginized” (who are actually running things, and doing it very badly), that “Joe Biden” turned around the economy, that “voting rights” equals non-citizens getting to vote, that election fraud is a “big lie” (and that the J-6 riot over it was an “insurrection”), and that the Covid vaccines were “safe and effective.”

None of these dishonest persuasions work anymore, and all of the persuasion machinery stands in plain sight like so many nauseating carnival rides. One by one, the rides are flying apart, scattering debris and body parts of the poor slobs who were on the rides all over the fairgrounds. And so, the fear rises in the ones running the carnival. The county sheriff stands by looking to round up the sleazeball carnies with their missing teeth and needle tracks inside their elbows. Before long, they will find themselves in the courtroom. . . .

The vicious officialdom put up the carnival and all of its rides to distract the public from the crimes they committed during and after the 2016 election. Donald Trump’s idle talk about putting Hillary Clinton in jail struck nerves throughout the federal bureaucracy, the halls of Congress, and the strongholds of the Clintons and the Obamas.

The Clintons had literally bought the Democratic Party apparatus under the DNC, using the money they grifted into the Clinton foundation from such operations as the Uranium One deal, the Skolkovo war-tech transfer deal, and the Haiti earthquake relief effort. They were sure that ownership of the DNC guaranteed the election for Hillary. It did guarantee that she would overcome Bernie Sanders’ primary election victories and the delegates that came with them, even after Julian Assange’s Wikileaks release informed the world just how the Clintons bought and paid for the DNC and the whole Philadelphia convention. Call this the birth of the “misinformation” cult, in which everything true was converted into a “big lie.”

The problem was, Hillary lost that election. What a surprise! Buying the convention was not enough, it turned out. Those “deplorables” did the unthinkable: cast enough of their stinky votes in just the right rust belt precincts to elect the Golden Golem of Greatness, who was as surprised as anybody, and really unprepared to cobble together an actual governing administration — in the process of which, Donald J. Trump was completely buffaloed by the outgoing Obama gang. They plotted by the lights of the White House Christmas tree to go after the interloper with all they had, starting with the surgical removal of a most dangerous appointee, National Security Advisor Mike Flynn, who knew all the secrets. . . and from there onto four years of Russia, Russia, Russia. . . .

It’s hardly a mystery anymore how “Joe Biden” got elected. It’s perfectly obvious despite the “big lie” narrative that the 2020 election was stoked with a veritable orgy of ballot fraud and direct election interference by agency rogues, especially the ones leaning hard on Facebook, Twitter, and Google to manipulate what the public actually saw. Don’t believe your lying eyes they told the nation. What is a mystery is why they chose “Joe Biden” to front for the cabal around Barack Obama actually running the show. Never before in US history was there a president who left such a slime trail of bribery and corruption. Just as they had spent all their energy the previous four years in undermining Mr. Trump, they had to spend the next four years propping up and defending “Joe Biden,” and then desperately trying to save their own asses from a Trump return. Meanwhile, they set out on their mission to wreck the country sufficient to clear the way for establishing a transhuman public-private utopia of crypto-Marxian “equity” (theft of property).

All of this political legerdemain summoned up the miasma of anxiety that beclouded the people of this sore-beset republic, and the nearly final blow to them was the Covid-19 operation, set in motion with the phony PCR test, that has now left a substantial number of citizens, vaccine-injured, disabled, and on-course for an early death — a pretty grotesque affront to our democracy. The victims are beginning to realize it.

The battery of Trump trials and lawsuits meant to put him totally out of business are now all simultaneously collapsing. Special Counsel Jack Smith is left doing Chinese fire drills around his office Keurig coffee machine. When the prank-fest in Judge Juan Merchan’s courtroom concludes, whether the jury sees the show for the farce that it is, or not, the Golden Golem of Greatness will be at large again among the voters. If he is clever enough to pick a capable veep that represents something like “assassination insurance” — say, Vivek, Tulsi Gabbard, or JD Vance — then the Obama cabal and the blob that has been protecting it will be swept out of power and into a dragnet of a kind of law actually associated with the word justice.

They are running out of ways to avoid it. All they’ve got left are the direst resorts: war, crashing the economy, another bio-weapon op against their own people, or an outright coup d’état. And even those probably won’t work.

  4. Teen suspended for using term ‘illegal aliens’ sues his North Carolina high school

A 16-year-old North Carolina student has sued his high school for suspending him after he used the term “illegal aliens” in a question about an assignment.

Christian McGhee, who received a three-day suspension for using the phrase last month at Central Davidson High School in Lexington, has accused the school of violating his First Amendment rights in the lawsuit filed in federal court Tuesday.

“Aside from the obvious fact that his words had nothing to do with race, his speech was protected under the First Amendment: he asked his teacher a question that was factual and nonthreatening, and officials could not have reasonably forecast that his question would cause substantial School disruption,” the suit said.

  5. Heightened Tensions: US Vows to Block Iran’s Nuclear Weapon Aspirations
    By
    Mahmoud Hakam –
    10th May 2024

Tensions are escalating between the United States and Iran regarding the latter’s nuclear program. Recent statements by Iranian officials raise concerns about potential policy shifts, prompting a firm response from the US State Department.

On May 9th, Kamal Kharrazi, a senior advisor to Iran’s Supreme Leader Ali Khamenei, hinted at a possible change in Iran’s nuclear stance if the country’s existence is threatened.

Matthew Miller, the US State Department spokesperson, condemned these remarks as irresponsible. Miller reiterated the US position that Iran will never get a nuclear weapon, emphasizing that diplomacy remains the preferred path forward. However, he stressed that all options are still on the table.

This exchange highlights a widening gap between the US and Iran. The US maintains that diplomacy is the key to a lasting and effective solution, but doubts linger due to Iran’s destructive actions and lack of cooperation with the International Atomic Energy Agency (IAEA).

The recent visit by IAEA Director General Rafael Grossi to Tehran yielded no concrete deadlines, further amplifying anxieties.

Adding fuel to the fire, other Iranian regime officials have echoed Kharrazi’s sentiments. Javad Karimi Qudousi, a member of Iran’s parliament, sparked fears with a social media post interpreted as a threat to build a nuclear bomb.

  6. Ascension Health, largest Catholic hospital chain in the U.S., hit by cyberattack, disrupting patient care
The attack follows another one that has caused a weekslong disruption to insurance giant UnitedHealth.

Ascension Health, the nation’s largest chain of Catholic hospitals, said Thursday it was responding to a cyberattack that was disrupting its operations.

In a press release on its website, Ascension said the attack had caused “disruption to clinical operations” as access to some systems had been interrupted.

“Our care teams are trained for these kinds of disruptions and have initiated procedures to ensure patient care delivery continues to be safe and as minimally impacted as possible,” it said.

An Ascension spokesperson did not immediately respond to a request for comment.

The company said it had engaged cybersecurity consulting firm Mandiant to assist in the investigation and remediation process, and had notified law enforcement authorities.

  7. Ninth Circuit Rules Some Felons Have Second Amendment Rights
    By Tom Knighton | 8:29 AM | May 10, 2024

Federal law holds that felons cannot lawfully buy firearms. For the most part, that’s a relatively non-controversial law, especially when you’re talking about violent felons.

Granted, many others argue that if a felon represents a danger, why are they out of prison in the first place? Further, those who are still a danger don’t seem to have a problem getting firearms anyway.

    Non-violent felons, though, are different.

After all, do we really need to be concerned that the guy who did two years for tax evasion–something I, personally, think should be a civic duty to some extent versus a heinous crime–is suddenly going to start knocking over liquor stores?

    Not really.

And according to the Ninth Circuit, of all people, those felons should retain their right to keep and bear arms.

Today’s U.S. v. Duarte, written by Judge Carlos Bea and joined by Judge Lawrence VanDyke, concludes that the Second Amendment protects some felons (at least after the end of their criminal sentences). The majority begins with the principle that:

[The Supreme Court’s decision in] Bruen instructs us to assess all Second Amendment challenges through the dual lenses of text and history. If the Second Amendment’s plain text protects the person, his arm, and his proposed course of conduct, it then becomes the Government’s burden to prove that the challenged law is consistent with this Nation’s historical tradition of firearm regulation.

It reasons, much historical analysis later, with the view that:

A more faithful application of Bruen requires the Government to proffer Founding-era felony analogues that are “distinctly similar” to Duarte’s underlying offenses and would have been punishable either with execution, with life in prison, or permanent forfeiture of the offender’s estate.

And, the majority concludes, this defendant’s particular past convictions—for vandalism, drug possession, evading a peace officer, and being a felon in possession of a firearm—did not qualify.

Judge Milan Smith dissents, concluding that pre-Bruen Ninth Circuit precedent categorically holds that all felons lack Second Amendment rights; the majority and the dissent disagree on whether Bruen overruled that precedent. The dissent, in particular, argues that

    (1) Bruen “repeatedly limited its definition of the scope of the right to ‘law-abiding’ citizens, using that phrase no fewer than fourteen times throughout the opinion,”

    (2) “Nothing … in Bruen reflects a retreat from the Court’s earlier statement in Heller that ‘longstanding prohibitions on the possession of firearms by felons and the mentally ill’ are ‘presumptively lawful,'” and

    (3) concurrences in Bruen reaffirmed the Heller view with regard to felons.

Now, while I understand legal stuff beyond what most people do, my understanding is well short of an attorney. I can’t begin to opine on the legal reasoning of these two because Judge Smith isn’t wrong in regards to what Heller and Bruen said.

But “presumptively” isn’t a synonym for “always”, and Bea and VanDyke also cited Supreme Court statements in their majority opinion.

    Now what?

The government may well file for an en banc hearing, which is where things get interesting. While it’s likely the ruling on Rahimi may influence the court, we still have two judges who support gun rights for non-violent felons, Benitez who may well support it as well. Depending on how Rahimi goes, it may well tip enough from the en banc panel to support the same.

Or, it may flip the other way and the DOJ decides to take this to the Supreme Court.

Either way, this just got interesting.

Breyer’s ‘Pragmatic’ Approach to Destroying the Second Amendment

    By Cam Edwards | 1:01 PM | May 10, 2024

Former Supreme Court Justice Stephen Breyer may no longer be in a position to decide cases that come before the Court, but he’s still trying to shape the judiciary in a way that would allow for judges to uphold virtually every gun control law the anti’s could dream up.
Breyer’s new book Reading the Constitution; Why I Chose Pragmatism, Not Textualism outlines his approach to interpreting the Constitution. I’m actually surprised he managed to fill several hundred pages with material, given that his view is basically that judges should have the power to ignore what the text of the Constitution has to say if they don’t like it.

Breyer highlights the need for considering the broader context in which laws are passed and the “practical consequences” of different interpretations. He refers to the majority judgment in New York State Rifle and Pistol Association v. Bruen (2022), in which he dissented. The Court held, 6–3, that New York’s law requiring a citizen to have a license to carry a gun outside his home violated the right to carry arms under the Second Amendment to the Constitution. Breyer expresses his disagreement with the ruling by emphasizing his preference to prioritize the practical implications. Considering the alarming patterns of gun violence in the US, Breyer believes the Court should have limited the access to firearms.

Does Breyer not know his history, or is he just choosing to ignore it? The Second Amendment was ratified shortly after a civil war that not only brought the United States its independence but led to small-scale reprisals between patriots and loyalists throughout the course of the war. As the Bill of Rights was being drafted and debated, the memory of Shay’s Rebellion was fresh in the mind of the Framers, while the Whiskey Rebellion broke out along the western frontier the same year the Second Amendment was ratified. The Founders knew all about “gun violence”. They just didn’t believe that disarming the American people was the answer.

Breyer’s criticism of textualism is based on his adherence to pragmatism. He contends that judges should endeavour to interpret the Constitution in a manner that is pragmatic and adaptable to the requirements of modern society. According to him, this approach is better aligned with the intentions of the Constitution’s framers, who intended for the constitution to be “workable” and responsive to evolving circumstances.,/blockquote>

The Constitution is responsive to “evolving circumstances”, but the proper way to do that is through an amendment, not a panel of nine justices deciding that is language can be discarded because they think it’s right thing to do in our modern age.
Breyer’s not the first to adopt a “pragmatic” approach to the Constitution, of course. I’d argue that Roger Taney’s decision in Dred Scott is actually a pretty good example of the pragmatic philosophy that Breyer espouses. Taney twisted the Constitution’s text beyond recognition in order to reach his conclusion that black Americans could never be entitled to citizenship and that Congress had no power to regulate slavery in the territories. He did so in the belief that the practical implications of his ruling would make the country a more peaceful place by removing the issue of slavery and abolition (which Taney considered an act of “Northern aggression” from the national debate.
Pragmatism, like beauty, is in the eye of the beholder. In Bruen, Breyer (joined by Justices Sotomayor and Kagan) argued that the majority opinion “refuses to consider the government interests that justify a challenged gun regulation, regardless of how compelling those interests may be,” adding “the Constitution contains no such limitation, and neither do our precedents.”

The text of the Second Amendment doesn’t include a clause after “shall not be infringed” that says “unless the government thinks there’s a good reason to do so”. The entire purpose of the Bill of Rights is to restrain the government from violating our individual rights, and the Fourteenth Amendment applies those protections to abuses from state and local governments as well. The only pragmatic way to change that while remaining faithful to the Constitution is to pass another amendment negating the right to keep and bear arms. That option has been available to the gun control lobby for decades, but as we’ve seen with Gavin Newsom’s proposed constitutional amendment, it’s not feasible because the support simply isn’t there.

Since repealing the right to keep and bear arms is off the table, Breyer (and others) are left to insist that the Constitution is essentially whatever they want it to be. That judicial arrogance is at the heart of some of the worst legal decisions in this country, including Dred Scott, but thankfully was consigned to the minority in Bruen. If Democrats are able to reshape the court in their image after the November elections, however, that “pragmatic” approach could very well become the majority view on the Court. Our right to keep and bear arms could disappear as quickly as Dred Scott’s right to live free did in 1857; not because the Constitution demands that result, but because the “pragmatic” enemies of individual liberty do.

  10. The United Nations General Assembly on Friday overwhelmingly passed a resolution asking the U.N. Security Council (UNSC) to reconsider granting full membership to the Palestinians – a move that would constitute de facto U.N. recognition of Palestinian statehood.

The General Assembly resolution, which is non-binding, passed with 143 nations in support, nine against, and 25 abstentions. The United States and Israel were among the nine votes against.

The resolution declared that the Palestinians meet all the requirements for membership, and that therefore the UNSC should “reconsider the matter favorably.”

The General Assembly cannot confer full membership on its own, but the resolution did bestow some privileges upon the Palestinians, including a non-voting seat among member nations in the U.N. Assembly hall.

The final draft of the resolution was carefully rewritten at the behest of China and Russia so that it could not be used as a precedent by people those murderous regimes are oppressing, such as Taiwan. It also had to be tailored to avoid triggering a U.S. law that would cut off funding for the United Nations if it recognized statehood for an organization that does not meet the requirements for such a designation.

Israel had barely begun its military operation in Gaza, after Hamas slaughtered 1,200 people and kidnapped 240 more, when the Biden administration began talking about what would need to happen the day after the war was over.

“There has to be a vision of what comes next,” President Biden said on Oct. 25, 2023.

Subsequently, the term “the Day After” was everywhere. In part, it was a device used to cast doubt on the Israeli military operation altogether, presenting it as an emotional response born of trauma and driven by a desire for vengeance – base instincts that can be tolerated only for so long. As summer and the DNC approaches, the Democrat hellhole of Chicago is facing a crisis with a major shortage of police officers.

At a public forum with the Commission for Public Safety and Accountability last week, Chicago Police Supt. Larry Snelling said, “What we’re doing right now is making the best with the number of officers that we have.”

Snelling added, “We are down. We’re down close to 2,000 officers.”

  19. The Gaza Pier Situation is tenuous and a possible set up for Beirut Barracks 2.0
    by John Mills May. 10, 2024 8:20 pm34 Comments

As the American domestic scene is distracted by the sudden appearance of the Palestinian “protesters” (née Antifers, née violent Transgenders, née Trust Fund malcontents), the Gaza Pier building exercise has been out of the spotlight. The real question should be, after at least 15 years of about a $1 Billion Dollars of year of funding donated directly to the UNRWA (United Nations Relief and Works Agency for Palestine Refugees in the Near East) – why has a modern port not already been made in Gaza? For some reason $1 Billion Dollars a year was not enough to at least have a simple seaport and pier.

The Biden Team made a policy decision to generate and deploy U.S. Army and U.S. Navy resources to create such a pier. The whole endeavor was announced simultaneously with the release of the Fiscal Year 2025 budget submission to Congress which eliminated more aircraft and ships than were lost at Pearl Harbor on December 7, 1941. Every line item of resources relevant to the Gaza Pier building went downward, which meant for every floating modular causeway section used, there were no replacements bought, and the likelihood of these sections being recovered and re-used is low. The pier building project was just completed and has now received its first hostile fire from Hamas.
Where is the mini-Iron Dome to cover the pier and American military?

Bonta, a Democrat who is mulling a run for governor, said he has been reviewing the work of his predecessor, Xavier Becerra, who filed more than 100 suits against Trump policies before leaving the office to become Biden’s secretary of Health and Human Services. Bonta and his deputies are also looking closely at a document drafted by the Heritage Foundation, a Trump-aligned think tank, known as “Project 2025,” that offers a blueprint for Trump’s second-term policy goals.
