40 lashes under ‘Islamic law’: men guilty of assault

Quite a day for Australian-Islamic news. Interesting how some of the Islamic community attempted to divorce the sharia component from this 100% sharia punishment for the ‘crime’ of imbibing alcohol that this convert to Islam did. Below the ‘click for more’ I will post a video on this exact thing from July 19 2011 as well as another one on Islamic attitudes on Australia at the time. Quite revealing and rather contrary to the tone of this article.

Four men have been found guilty of giving a Sydney electrician 40 lashes with a cable, which they said was a punishment under Islamic law for drinking alcohol and using drugs.

Zakaryah Raad, Tolga Cifci, Wassim Fayad, and Cengiz Coskun were today convicted of several charges relating to whipping Cristian Martinez, a convert to Islam, in July 2011.

Mr Fayad counted out the lashes and when he came up to number 10 … he gave Mr Martinez a break. Mr Martinez went into the bathroom and vomited.

Magistrate Brian Maloney told Burwood Local Court on Thursday it was an extremely unusual case.

“Until now, assaults occasioned in the course of a religious practice involving the mortification of the flesh have not been before any court in any common law country.”

Mr Maloney said that, from the outset, prosecutors were clear the case was not about sharia, or about the Islamic faith.

  1. The accused stated that the flogging constituted punishment under Islamic law for drinking alcohol and using drugs. Yet Magistrate Maloney claims the prosecutors were clear the case was NOT about sharia or the Islamic faith. Hmmm, not about sharia? Sheikh Qaradawi, considered to be the top Al-Azhar University scholar and head of the European Council for Fatwa and Research, in 2008 issued a fatwa that says consuming alcohol is prohibited (a level of .5% is allowed due to natural fermentation). Anything above .5% exacts punishment, because the Koran views alcohol as sinful (2:219) and as an abomination of Satan’s work (5:90). In the major Hadiths, drinking alcohol is punishable with 40-80 lashes, with palm branches stripped of their leaves, or with shoes or twisted garments: “For drinking wine the Prophet ordered forty stripes of two lashes” (Sahih Muslim, Vol.3 book 15, 4226-4228). Another Hadith punishes drinking with death after two cautionary floggings: “The Prophet said, ‘If they drink wine, flog them. Again if they drink it, flog them. Again if they drink it kill them” (Abu Dawud, 38:4467). But in 38:4469, those who drink a fourth time will be killed, they get one extra cautionary flogging. And finally, in Hadee’s-e-Qudsi 19:5 (Ahmad): “Allah said that if a man took even a mouthful of wine, He would make him drink the same quantity of pus of the wounds of the people in Hell.” Not about shariah? Think again.
